Tenancy agreements are a tenants’ best friend

Assured shorthold tenancy agreements (the default agreement format for buy to let tenancies) ‘assure’ tenants that unless they break the terms of the agreement they can stay for at least six months. They ‘assure’ landlords that they can regain possession of their properties at the end of the tenancy.

When landlords reach that position they can issue tenants with what is known as a ‘section 21’ notice to quit (‘section 21’ being a reference to the relevant paragraphs in the Housing Act).

This notice must be in writing and allow at least two calendar months from the date the tenant receives the notice before possession is required – if a fixed term tenancy, not expiring before the end of six months, nor expiring before the end of the agreement or a date specified the agreement as when a break clause may be exercised (as long as this is after at least six months). Notices may not be issued before tenancies commence.

There is no particular form of wording required, however, they must include a statement that:

1) If the tenant or licensee does not leave the dwelling, the landlord or licensor must obtain an order for possession from the court before the tenant or licensee can lawfully be evicted. The landlord or licensor cannot apply for such an order before the notice to quit or notice to determine has run out.

2) A tenant or licensee who does not know if he or she has any right to remain in possession after a notice to quit or a notice to determine runs out can obtain advice from a solicitor. Help with all or part of the cost of legal advice and assistance may be available under the Legal Aid Scheme. He or she should also be able to obtain information from a Citizens’ Advice Bureau, a Housing Aid Centre or a rent service.

Notices can be delivered in person or by post. Landlords should retain copies and any proof of delivery, such as special delivery slips.

Should a tenant, having received proper notice, not give up possession by the specified date, the landlord will be obliged to issue possession proceedings in the county court. If the tenant still will not move out, the landlord can apply for a warrant of execution when bailiffs will be appointed who will oblige the tenant to leave.

Landlords can also seek to regain possession of their property during the course of the assured shorthold tenancy agreement if particular circumstances arise - including, for example, rent falling into arrears. The reasons are listed in the 1988 Act as various ‘grounds;’ for possession.

Some are ‘mandatory’ meaning that if the grounds are justified, the court has no option but to grant possession to the landlord. Other grounds for possession allow the court discretion about what to do.
The mandatory grounds for possession are:

  • Ground 1: a prior notice ground - The property was previously the landlord’s only or main home. Or, so long as the landlord or someone before him or her did not buy the property after the tenancy started, the landlord (or landlord’s spouse) requires it to live in as his or her main home.
  • Ground 2: a prior notice ground - The property is subject to a mortgage which was granted before the tenancy started and the lender, usually a bank or building society, wants to sell it, normally to pay off mortgage arrears.
  • Ground 3: a prior notice ground - The tenancy is for a fixed term of not more than 8 months and at some time during the 12 months before the tenancy started, the property was let for a holiday.
  • Ground 4: a prior notice ground - The tenancy is for a fixed term of not more than 12 months and at some time during the 12 months before the tenancy started, the property was let to students by an educational establishment such as a university or college.
  • Ground 5: a prior notice ground - The property is held for use for a minister of religion and is now needed for that purpose.
  • Ground 6: - The landlord intends to substantially redevelop the property and cannot do so with the tenant there. This ground cannot be used where the landlord, or someone before him or her, bought the property with an existing tenant, or where the work could be carried out without the tenant having to move. The tenant’s removal expenses will have to be paid.
  • Ground 7: - The former tenant, who must have had a contractual periodic tenancy or statutory periodic tenancy, has died in the 12 months before possession proceedings started and there is no one living there who has a right to succeed to the tenancy.
  • Ground 8: - The tenant owed at least two months’ rent if the tenancy is on a monthly basis or 8 weeks’ rent if it is on a weekly basis, both when the landlord gave notice seeking possession and at the date of the court hearing.

(A prior notice ground means that the landlord must have notified the tenant in writing before the tenancy started, probably in the tenancy agreement itself, that he or she might seek possession on this ground).
Discretionary grounds on which the court may order possession are:

  • Ground 9: Suitable alternative accommodation is available for the tenant, or will be when the court order takes effect. The tenant’s removal expenses will have to be paid.
  • Ground 10: The tenant was behind with his or her rent both when the landlord served notice seeking possession and when he or she began court proceedings.
  • Ground 11: Even if the tenant was not behind with his or her rent when the landlord started possession proceedings, the tenant has been persistently late in paying the rent.
  • Ground 12: The tenant has broken one or more of the terms of the tenancy agreement, except the obligation to pay rent.
  • Ground 13: The condition of the property has got worse because of the behaviour of the tenant or any other person living there.
  • Ground 14: The tenant, or someone living in or visiting the property:
  • has caused, or is likely to cause, a nuisance or annoyance to someone living in or visiting the locality; or
  • has been convicted of using the property, or allowing it to be used, for immoral or illegal purposes, or an arrestable offence committed in the property or in the locality.
  • Ground 15: The condition of the furniture in the property has got worse because it has been ill treated by the tenant or any other person living there.
  • Ground 16: The tenancy was granted because the tenant was employed by the landlord, or a former landlord, but he or she is no longer employed by the landlord.
  • Ground 17: The landlord was persuaded to grant the tenancy on the basis of a false statement knowingly or recklessly made by the tenant, or a person acting at the tenant’s instigation.

The landlord must serve notice seeking possession of the property on the tenant before starting court proceedings. He or she must give the following amount of notice:

(a) for grounds 3, 4, 8, 10, 11, 12, 13, 15 or 17 – at least two weeks;
(b) for grounds 1, 2, 5, 6, 7, 9 and 16 – at least two months.

There is nothing to stop a landlord citing more than one breach of the tenancy agreement giving grounds for requiring possession, say ground 8 - the tenant owes at least two months’ rent  - and ground 9 - the tenant was behind with his or her rent both when the landlord served notice seeking possession and when he or she began court proceedings.

In less complicated cases involving assured shorthold tenancy agreements there is what is supposed to be a quicker method of gaining possession which may avoid the need for a court hearing. The ‘Accelerated Possession Procedure’ limits claims to possession and the cost of making the application and cannot be used, for example, to claim for rent arrears – although the small claims court can still be used for this.

The court will normally make its decision by looking at the written evidence provided by the landlord and the tenant – which means special care is needed in making sure all relevant evidence is included with the claim.

During the fixed term of an assured or shorthold tenancy agreement, the landlord can only seek possession if one of grounds 2, 8, 10 to 15 or 17 apply and the terms of the tenancy make provision for it to be ended on any of these grounds. When the fixed term of an assured tenancy ends, possession can be sought on any of the grounds.

When the fixed term of a shorthold tenancy agreement ends, the landlord does not have to give any grounds for possession.

However, US troops are now in Afghanistan.   The situation there is dire.  The injury and deaths of children and women by Taliban and insurgents in the first 6 months of 2010 were higher than the first 6 months of 2009.  Additionally, some fear a further increase of violence toward women and children if the Taliban is included in a coalition government. In Time magazine (vol. 176, No. 6 , 2010) the cover article, Betrayed, discusses fears that Afghan women have about Taliban beliefs and practices returning in an integrated government which includes them.

The example given is Bibi Aisha, an 18 year old , who had her nose and ears sliced off because of orders of the Taliban leadership. Bibi ran away from abusive in-laws who beat her and made her sleep in the barn. The slicing off of parts of her face and head was her punishment for running away.  She was left to die, but survived to tell her story. She was taken to a US military medical unit by her father because the local Afghan hospital would not treat her. Other members of her own family would not help her.  From the US military medical unit, she was taken to a shelter created and supported by a US organization, Women for Afghan Women (WFAW). It has now been reported that she will come to the US for reconstructive surgery. Additionally, Time reported that the religious council of Taliban influenced Herat province issued an edict in May forbidding women from leaving their homes unless accompanied by a male relative.

Taliban law forbids the education or employment of women or examination by a male doctor without the presence of a close male relative. Since women were teachers and nurses, these professions have practically disappeared in parts of Afghanistan. This has caused the physical, mental, and intellectual health of women under Taliban rule to deteriorate. Burqas are required clothing for women under Taliban rule. A burqa covers the entire body of a woman in tent like fashion, with only a small window with which to see. Under Taliban law, women not wearing burqas or unaccompanied by a male relative outside the home can be beaten in public with sticks. Women, by law, were only allowed to read the Qur’an and windows must be blackened so no one could see into houses. We now have in the news a woman who was to be stoned to death for adultery in Iran. This is also a Taliban law. With international publicity, the stoning has been suspended, but can be reinstated at any time. We see from this that open international dialogue can have some positive effects.

The rules of the Taliban date back to the 1400’s.  It takes them back to a time when disease was rampant, women were property, sanitary systems for waste had not yet been invented, there was no TV or schools for girls and men were in charge.  In the Middle ages, torture was an acceptable form of punishment or of forcing confessions. This represents a very primitive way of living. This lifestyle is supported by the opium trade, as well.  The world has advanced since then, morally, ethically, and socially.  These are moral and humanitarian issues, not religious issues.

On the positive side, female talk Show host, Mozhdah Jamalzadah, is an example of how some things are changing in Afghanistan. She has her own TV show and fears she may lose it if the Taliban are included in a coalition government. The constitution of Afghanistan now guarantees equal rights for women and it is said that this is non-negotiable. However, the constitution also cannot contradict Islamic law (Shari’a) which is yet to be defined in the constitution. The Taliban has the most restrictive interpretation of Islamic law. There are fears that with sufficient votes, the laws and practices will return to Taliban restrictions when the US leaves Afghanistan and the Taliban joins the Coalition government.

Women for Afghan Women (WFAW) have shelters in Afghanistan for abused women. The Taliban wants them declared as brothels and eliminated. They have also burned down girls schools. WFAW have counseling centers to help end violence against women. Their fate is in questionable hands if the US removes troops from Afghanistan. There are 15 million women in Afghanistan. Some have already started wearing burqas again, fearing the influence of the Taliban on a coalition government when US troops leave Afghanistan.

So, are the difficulties in Iraq, Afghanistan, and Iran, at least in part, about women’s rights and human rights? If they are, does this represent larger moral, human rights, and psychological issues? Is it more like Nazism, Apartheid, slavery, or any other violence against a single group? Slavery of one group by another cannot be allowed. “Absolute power corrupts absolutely” (Lord Acton, 1887). As was seen in the Zimbardo Prison Experiment, one group having absolute power over another and thinking of them in derogatory terms leads even “normal” people to become extremely cruel toward the “undervalued” group. We also know that when a group with cruel beliefs about another group, as in Rwanda, is isolated and does not have the oversight of a larger society or organization, there is the risk of abuse of power and extreme violence.

The psychology research is clear that being exposed to violence against women in the home can contribute to children growing up to be heartlessly and criminally violent as adults. It appears from news reports that the Taliban, as a sub-culture, is cruel and demeaning toward women. It would be logical that a societal sub-culture, such as the Taliban, would raise children that are violent toward others. We cannot stop terrorism until we stop cruelty toward women in the Middle East.

The role of oil, the opium trade, and emeralds in the conflicts in the Middle East cannot be ignored. Whoever controls the country controls the very rich resources. So the conflicts are about power, ideology, resources and who controls them. Nothing new there. Young Taliban recruits are told that if they allow women to be educated and have freedom, the Afghan men will lose their power. Therefore, their position of control depends on the control of women by any means necessary. By the way, TV and radio are also banned by the Taliban, so no one gets new ideas.

The question is, “What do we want to do about it?” Did Slavery, Apartheid, or Nazism end without violence? No.  How far do we go to end a cruel sub-culture that enslaves part of its group (women)? I am not advocating for ongoing war forever.  diplomacy and humanitarian aid has a place, as well.  My goal is to put the conversation openly on the table. I am advocating for calling cruelty what it is, unacceptable. If cruelty and enslavement of women is culturally acceptable by one group, the larger society must say, “No, this is not acceptable.” Some are afraid to say so because it is presented as part of a religion and it is politically incorrect to criticize someone’s religion.

What would have happened if everyone was silent about the inappropriateness of slavery? We would still have slavery. We must have the necessary conversations with everything out in the open. This article is a contribution to the dialogue. There may be positive or negative feedback. Either will generate discussion. Cruelty can only exist in secrecy. Open discussion is needed but not sufficient.  The criminalization of abuse of women and children in Afghanistan is needed and should be enforced by law throughout the country.

Some of you who work with elementary aged kids are wondering what sort of crafts to do with them, then you may like to find things that help them use their imagination in a sense that they also develop their motor skills. One of the things you need to remember is that they need to work with both their hands as well as their minds. So, you might find that creating something out of molding clay is something that they really benefit from.

Why I Write for Tweens

Inspired and enthused about writing another adventure for Belle and Winnie, in my sequel to Belle in The Slouch Hat, I sat in front of my computer and placed my forearms on the armrests. I extended my fingers toward the keyboard with my forearms slightly angled down, and noticed my right pinky finger had developed a permanent downward curve in it. That didn’t bother me because I felt grateful that I had found something I love doing as much as I did when I had a real paying job. I straightened my back, threw back my shoulders and smiled to myself about the joy I find in writing for tweens. Suddenly, a thought rushed through my mind that the main reason I like writing books for tweens is because we have the same mentality! I gasped and gradually lifted my fingers off the keyboard; I folded my hands and quietly placed them in my lap. My shoulders automatically slumped and I gently, and ever so slowly, lowered my head to prevent the annoying cracking sounds my neck makes when it moves after I sit at the computer for any length of time. I took in a deep breath, shut my eyes, relaxed my body and calmed my mind by counting backwards from seven to one.

Determined to know where that thought came from, I looked around to make sure no one was listening to me, and I repeated the question out loud, “Is the main reason I like writing for tweens because we have the same mentality?” Within a nanosecond I heard a small voice inside my head say, blah, blah, blah, blah, blah, maybe ya do, and maybe ya don’t. The next thing I knew all of my fingers were properly positioned back on the keyboard and I began writing this article on why I write for tweens, those precious 8 to 12 year olds.

There are many reasons I enjoy writing for tweens, and one is because I have tween grandchildren, ages nine, ten, and twelve. I’ll have two more next year, and in four years two more tweens will come into my life.

I love the innocence of tweens and their ability to believe in the Tooth Fairy, Santa Claus, ghosts, goblins, and mythical creatures. After spending a day with her, I continue to bask in the love and fun we share for a least two more days. Being with grandchildren is the best anti-aging product on the earth. Recently, I took her with me to make a donation to the Salvation Army homeless shelter; afterward, she innocently lifted our spirits by choosing a trip to have a delicious frozen yogurt. During my cherished time with her, I interviewed her and we took turns writing down her advice on how to write for tweens. I have not changed her words because they are the words of an expert reader!

Things you need to know before you write for tweens: When you write for tweens it cannot be boring. You want a hint of love, but no kissing. Use medium words; not new words we have to look up (trust me). It doesn’t matter what the time, or where the place is for the story; but if you write about the past you need to have lots of adventure in it.

Advice for the author: If the author doesn’t have fun; the reader doesn’t have fun.

Important things to make a good story: One of the main characters needs to be pretty, or handsome, but don’t make it like a fairytale with too many princesses. Trick the reader; it is good for our brains. have lots of action and scary parts, but not all scary. You need jealousy because it leads to fighting and fighting leads to disaster, and disaster leads to hatred. You really need fighting in a good story. Have lots of hanging parts, it keeps you on the edge of your seat.

Important things about the good guys and the bad guys: Have the good guys care about each other and only give the bad guys one chance. If you have a big bad guy make him so bad he will kill some of the other bad guys.

Important things about a good ending: Don’t let the main character die. Have a big wrap up at the end.

Because of the onset of puberty, tweens are experiencing a lot of physical changes and can have tremendous mood swings. They are fragile, yet tough; hot one minute and cold the next. Then out of the blue, they will surprise you by sharing some of their special love emotions that will lift your spirits so high above those complex puberty hormones you will never want to come down.
